Felony Convictions and Law Enforcement and Other Agencies

Criminal records are maintained by various agencies. Most of the general public will not have access to the contents of the record. However, law enforcement and the courts will still have access to the records, as will a few employers and other entities as allowed by law.
Upon receiving an expungement order, we send notice of the expungement to the Kansas Bureau of Investigation (KBI) which shall notify the Federal Bureau of Investigation (FBI), the Secretary of Corrections, and any other criminal justice agency which may have a record of the arrest, conviction or diversion.

Expunge A Felony

Expunged records are removed from most searchable public databases. Other agencies will update their records to show that a conviction has been removed from your record.

Other Remedies

If your record does not qualify for expungement or seal, you may wish to look into a Gubernatorial pardon - a Pardon from the Governor. This is an entirely different process from standard expungement and is not often granted. If your case qualifies, we can help you make a Petition and request a pardon from the Governor.

What Cannot Be Sealed or Expunged

Capital murder, voluntary or involuntary manslaughter, Sexual battery, Rape, and many violations involving children are not able to be expunged. See below for more information or give us a call if you aren't sure.

How Long Does it Take

How long your case will take depends on the size of the jurisdiction you are in, whether there is an objection to your Petition, and how long it takes to get your case on the docket.

Do I have to tell a potential employer after my charge was expunged or sealed?

No. In Kansas, it is against the law for employers or potential employers (except those specifically allowed by law) to ask you whether you ever had any records expunged or sealed.
