These Terms govern your use of grabbelaw.com and our related forms and text messaging (together, the “Site”), operated by Grabbe Law Office (“we,” “us”). By using the Site, you agree to these Terms.

1. No legal advice; no attorney-client relationship

The content on the Site is general information, not legal advice. Using the Site, submitting a form, or contacting us does not create an attorney-client relationship. That relationship starts only when we both sign a written engagement agreement. Until then, please don’t send confidential information beyond what our forms request. This website is for informational purposes only and may be considered attorney advertising.

2. Engagement agreement controls

Your engagement agreement sets our fees, the scope of our services, and the terms of our representation. If these Terms conflict with your engagement agreement, the engagement agreement controls.

3. No guarantee of results

The USPTO decides whether a trademark is registered. We can’t guarantee that any application will be approved, that a mark is available, or how long the process will take. Past results don’t guarantee future outcomes.

4. Accuracy of your information

You agree that everything you give us is true, complete, and current, including owner details, dates of use, goods and services, and specimens. Trademark applications are signed under declaration, and false statements can be punished under 18 U.S.C. § 1001. They can also make an application or registration invalid or unenforceable. Tell us right away if any of your information changes.

5. Text messaging program

Grabbe Law Office offers two optional text programs:

Client updates (non-marketing): status updates, document requests, and appointment reminders about your matter.

Marketing (separate opt-in): trademark tips, service announcements, and special offers.

For both programs:

Frequency: Message frequency varies. Rates: Message and data rates may apply.

Opting out: Reply STOP at any time to opt out. You’ll receive one confirmation message and no further texts from that program.

Help: Reply HELP for help, or contact [email protected] or 785-621-4711.

Consent: Consent isn’t a condition of purchasing any service.

Carriers: Carriers aren’t liable for delayed or undelivered messages.

Privacy: See our Privacy Policy for how we handle your information. Mobile information isn’t shared with third parties for marketing purposes.

6. Acceptable use

When you use this site, you do so at your own risk and accept all risks when you send any information through a form on this website. Don’t misuse the Site. That includes submitting false information, spam or someone else’s information without permission, uploading malicious files, or trying to interfere with the Site’s operation. Grabbe Law Office assumes no liability for interception, alteration, or misuse of information transmitted over the Internet. In no event will we be liable to you for any loss of use, interruption of business, or any direct, indirect, special, incidental or consequential damages of any kind (including lost profits). We do not warrant or guarantee that the information on this website is accurate or up-to-date.

7. Intellectual property

We own the Site’s content, including its text, graphics, and logo, or have permission to use it. You may view and print it for personal use. Don’t copy or republish it without our written permission. You keep ownership of anything you upload, unless otherwise agreed to in writing. You give us permission to use it to provide our services, including filing it with the USPTO.

The Site may link to third-party websites, such as the USPTO’s. We do this for your convenience only. Links to other websites are not an endorsement or approval of those sites or their owners. Those websites are not under our control and we are not responsible for those websites, the information, services or products they may offer, or any loss or damage you may have at those sites.

9. Disclaimers and limitation of liability

The Site is provided “as is,” without warranties of any kind. To the extent the law allows, we aren’t liable for indirect, incidental, or consequential damages arising from your use of the Site. Nothing in these Terms limits any duty or liability that can’t be limited under the Kansas Rules of Professional Conduct.

10. Governing law

Kansas law governs these Terms. Any dispute will be resolved in the state or federal courts located in Ellis County, Kansas.

11. Changes

We may update these Terms from time to time. The effective date above shows when they were last changed. If you keep using the Site after an update, you accept the updated Terms.
